Miller settles lawsuit over exploding beer bottle


The federal court has dismissed with finality a Nepalese couple's lawsuit against the Milwaukee-based Miller Brewing Co. over an alleged exploding beer bottle that caused permanent vision loss to the husband's right eye.U.S. District Court for the NMI Chief Judge Alex R. Munson on Tuesday dismissed the lawsuit filed by Hari Bahadur Bhujel and his wife, Dhan K. Bhujel, after the parties reached a settlement agreement.The Bhujel couple, through counsel David G. Banes, and Miller Brewing Co., through attorney John D. Osborn, asked the court to dismiss the matter.In granting the request, Munson said the court shall retain jurisdiction over the parties and the lawsuit for purposes of obtaining and entering an order in aid of judgment to enforce the terms and provisions of the settlement agreement if the need arises.Munson said the parties shall bear their own costs and attorneys' fees.The judge closed the file and ruled that any pending motions are dismissed as moot.In September 2006, the Bhujel couple filed a $2-million lawsuit against Miller Brewing Co., the manufacturer of Miller MGD Beer. The plaintiffs sued the company for negligence, negligent infliction of emotional distress, breach of implied warranty, violation of the Consumer Protection Act, and loss of consortium.Hari Bahadur Bhujel was working as a bartender in AJ's Restaurant in Susupe.According to Banes, on Sept. 24, 2004, while Bhujel was doing a routine check of the beer supply and was opening a cooler to count the number of beers inside, a Miller MGD beer bottle exploded in his face.Glass shrapnel of the bottle hit Bhujel's right eye, causing laceration and extensive damage.An opthalmologist determined that Bhujel lost 85 percent of his central vision, Banes said.

President tells Katawal to stay in position




President Dr Ram Baran Yadav has written to the army headquarters instructing Rookmangud Katawal to stay in position, despite sack orders from the government.
The President intervened in the issue following a memorandum submitted by 18 political parties including Nepali Congress and the CPN (UML).
President Yadav sent a letter at 10.30 pm Sunday to the army headquarters asking Katawal to continue in his position as Chief of Army Staff. The president gave such orders in capacity of commander-in-chief of the Nepali Army.
A copy of the letter was sent to Prime Minister Pushpa Kamal Dahal. However, the PM reportedly refused to accept the letter.
PM Dahal has dubbed the President’s intervention as unconstitutional.
An emergency meeting of the army generals was called Sunday night after receiving the letter.
Earlier, an all party meeting held at UML headquarter, Balkhu decided to urge the President to protect the constitution by intervening in the government decision to sack CoAS Katawal. nepalnews.com May 04 09

Maoist leaders decide to launch protest in streets, parliament

The top leaders meeting of the ruling Unified CPN (Maoist) held Monday morning has decided to launch protests in streets and in parliament against the move of the President Dr Ram Baran Yadav.
According to our correspondent Kishor Poudel, Maoist leader Top Bahadur Rayamajhi told media persons after the meeting in Baluwatar that his party would also call on the judiciary against the president’s action.
He said the meeting termed the president’s action as “so called coup” alleging him of trying to impede in constitution making efforts and peace process. “This has reflected the incident of February 1, 2005,” he said.
The meeting of the council of ministers has been called at 1 p.m. before Prime Minister Pushpa Kamal Dahal addresses the nation. Right after the nationwide address, Maoist central secretariat meeting has been called for the second time in a day. nepalnews
